PROTOCOL
The Protocol signed with UPFR establishes the ways of collaboration, as well as the terms and conditions of the cooperation, in order to inform the DJs from Romania on their respective legal responsibilities when using phonograms in professional activities (through reproduction and public communication), to obtain non-exclusive license from the producers of phonograms (via UPFR) and to pay the legal remuneration.
Through this Protocol, the Parties set themselves to develop together:
- sharing information through various media channels about copyright incidence and related rights in DJ& s business, including information and researches on legal provisions which require the observance of these rights;
- actions to prevent the phenomenon of piracy (unauthorized reproduction of phonograms and their ownership for the purpose of public communication or distribution);
- actions for monitoring, analyzing and highlighting cases of infringement of copyright and related rights;
- common actions which facilitate the procurement of the non-exclusive licenses for the use of phonograms: reproduction and public communication in ambient and gainful purposes.
ADJPR undertakes:
- to notify its members about the obligation to obtain non-exclusive license and about the obligation to pay the remuneration established by Methodologies, in cases of reproduction and public communication of phonograms for the ambient and gainful purposes, including the notification about the licensing conditions, methods of reporting, remuneration, etc.;
- to make all the efforts in representing the ADJPR members who perform DJ& s activities in relation with UPFR, in order to obtain licenses and to ensure the payment of remuneration;
- to notify in writing the ADJPR members about the risk of infringement of copyright and related rights through the unauthorized use of phonograms, through the unauthorized reproduction of the phonograms and their ownership in public communication purpose;
- to stipulate in the DJ& s occupation standards, also the need to own the licenses regarding the observance of the copyright and related rights.
